I have been in the bilge of many 28B's. Most have lots of rust. An old boat,in salt water adds up to lots of rust. If it sank I would be more worried about the wiring; but most older 28B's have some wiring trouble even if they were not sunk. I used to power wash my engine compartment every week. Lots of fresh water all over everything. Then run the engines to get them hot and leave the hatches open to dry out. My 28B had two almost zero hours 302 gasser that had plenty of rust on them. A good wire brushing, a couple cans of rustoleum "rusty metal primer" followed by rustoleum gloss black and I had what looked like new engines. It just takes time and effort to keep 28B's rust free.
As UV said forget the lawsuit it will be a waste of effort. The rust is pretty obvious; and the boat could have "sunk" on land. Someone leaves the plug in and the boat fills with rainwater. Proving which will be impossible.
