A hot compressor is caused by low water flow, good water flow but dirty cond coil not transfering heat, high head pressure caused by a blockage in the system or over charged.

Now the 37 degree output is getting very close to freezing. Once you reach that point, the evap will ice up.

I can't think of a situation where the controls would cause a hot compressor without burning a wire end.

I would pop a gauge set on to see what the suction and high side readings are.

Feel the cond coils, they should feel very warm while the compressor is running, if not they ain't workin.

I know you already figured most of this out.

Why don't you stuff some of the bodies in the sink hole that our favorite Fed man chases after.
Save the citizens the cost of a trial.
